that occurred yesterday at the court one
0:27
Justice Johan Machan was presented the

judgment is published in our audio and

0:35
President elect Donald Trump was
0:37
sentenced to unconditional discharge for
0:40
34 charges of business fraud related to
0:43
harsh money payment to stomy Daniels
0:45
during the 2016 presidential campaign
0:49
President elect Donald Trump was
0:51
sentenced Friday morning in New York
0:54
after the Supreme Court refused to block
0:56
the sentencing making him the first US
0:59
president to be convicted and sentenced
1:01
for a crime to take office Trump
1:04
appeared virtually from myo according to
1:07
local media While others also reported
1:09
that he appeared virtually for the
1:11
sentencing at a courtroom in New York
1:14
Trump could have been sentenced of up to
1:16
4 years in prison but inad was delivered
1:19
a sentence that does not include
1:21
penalties like J ter or probation in
1:24
what's called an unconditional discharge
1:27
an unconditional discharge illegal ter
1:30
means that the person is convicted of
1:32
the charges but is not punished further
1:35
such as with Jael time probation or
1:38
fights essentially they are released
1:41
without any conditions attached to their
1:44
discharge this can happen in cases where
1:47
the court determines that the conviction
1:49
itself serves as enough of a deterrent
1:51
or punishment according to local
1:53
observers in the United States of
1:56
America Trump doesn't face any jail time
1:59
FS or probation but his conviction still
2:03
stands and he will enter office as a
2:05
convicted fellon one of The Observers
2:08
added the source news media reported
2:11
that George Machan emphasized that while
2:14
the office of the presidency grants
2:16
considerable legal protections those
2:18
protections do not diminish the
2:20
seriousness of the crime one power that
2:23
do not provide is the power to erase a
2:25
jury verdict marchan stated
2:28
acknowledging the citizen role in
2:30
returning Trump to office despite the
2:33
conviction according to CNN Trump
2:36
appearing virtually from myo maintained
2:40
his innocence the fact is I'm totally
2:43
innocent I did nothing wrong he said
2:46
calling the case a political Witch Hunt
2:49
designed to damage his reputation Trump
2:53
also criticized Manhattan district
2:55
attorney Alin BR claiming the case was
2:58
unwarranted and H New York York's
3:00
Judicial System New York states that
3:03
unconditional discharge is when a
3:05
defendant is convicted without
3:07
punishments such as imprisonment a fine
3:10
or probation
3:12
supervision while Trump expressed
3:14
dissatisfaction with the outcome his
3:17
legal team views the sentencing as a
3:19
step toward appealing the conviction
3:22
despite his felony conviction the
3:24
unconditional discharge means Trump will
3:27
face no further penalties directly tied
3:29
to the case allowing him to focus on his
3:32
political agenda and upcoming cabinet
3:34
confirmations the sour report ends in
3:37
quote President elect Donald Trump on
3:40
Friday was sentenced to unconditional
3:42
discharge just 10 days before his
3:45
inauguration the case stem from
3:47
accusations that he falsified business
3:49
records to conceal a
3:52
$130,000 payment to stomy Daniels who
3:55
claims to have had an affair with Trump
3:57
in 2006 a claim he denies calling the
4:01
prosecution politically motivated Trump
4:04
during the sentencing discussed his 2024
4:07
election Victory claiming he won the
4:10
popular vote by millions and millions of
4:13
votes and secured all seven swing States
4:16
adding they've been watching your trial
4:20
so they understood it referring to the
4:22
voters he also argued that legal fees
4:25
were recorded by accountants as legal
4:28
expenses not by him personally legal
4:31
fees were put down as legal expenses by
4:34
accountants the W put down by me Trump
4:38
said it's incredible actually would your
4:41
client like to be
4:43
heard yes thank you youor this has been
4:47
a very terrible experience I think it's
4:50
been a tremendous setback for New York
4:52
and the New York court
4:53
system uh this was a case that Alvin
4:56
brag did not not want to bring
5:00
uh he thought it was from what I read
5:03
and from what I hear
5:06
inappropriately um handled before he got
5:09
there a gentleman from a law firm came
5:12
in and acted as a district
5:15
attorney and that
5:17
gentleman from what I heard was a
5:20
criminal or almost criminal in what he
5:23
did it was very inappropriate it was a
5:26
somebody involved with my political
5:29
opponent
5:30
part of the records that we're talking
5:33
about they're saying I just noticed
5:35
where he said I was falsifying business
5:38
records well the falsification of
5:41
business records as they said it was
5:43
calling a legal expense in the books
5:44
where everybody could see them a legal
5:46
expense in other words that legal fees
5:48
or legal expense were put down as legal
5:51
expense by accountants they weren't put
5:54
down by me they were put down by
5:55
accountants I didn't call them
5:57
construction concrete work I didn't call
6:00
them electrical work I didn't call them
6:02
any they called a legal fee or a legal
6:04
expense a legal expense and for this I
6:07
got
6:08
indicted uh it's incredible actually now
6:11
if you look my attorney alluded to it uh
6:15
the top legal Scholars and legal
6:19
pundits in this country the ones that
6:21
are quoted all the time on television
6:24
that are uh making their views felt and
6:26
highly respected people uh have said
6:30
everyone virtually everyone that I know
6:32
of I haven't seen any to the contrary
6:35
not one and none these people not
6:38
exactly friends of mine to put it mildly
6:40
but they all said this is a case that
6:42
should have never been brought it's an
6:44
injustice of
6:46
Justice uh very respected Jonathan
6:50
Turley Andy
6:52
McCarthy Judge David riffkin a wonderful
6:55
man who just passed away by the way uh
6:58
Greg
7:00
Ellie honig from CNN of all places CNN
7:04
said that Paul and
7:06
graia Alan dtz they all said this is not
7:10
a case that should be brought it's not
7:13
think about legal expenses are down as
7:15
legal expenses and and I get indicted
7:18
for business records everybody should be
7:20
so
7:21
accurate uh it's been a political Witch
7:23
Hunt it was done to damage my reputation
7:27
so that I'd lose the election and
7:29
obviously that didn't work and the
7:31
people of our country got to see this
7:33
firsthand because they watched the case
7:34
in your courtroom they got to see this
7:36
firsthand and then they voted and I W
7:38
and got the number of votes by far of
7:41
any Republican candidate in history and
7:44
one as you know all seven swing States
7:48
one conclusively all seven swing States
7:52
and one uh the popularity the popular
7:54
vote by millions and millions of votes
7:57
and they've been watching your trial so
7:59
they understood it uh I wasn't allowed
8:02
to use the lawyer client privilege or
8:05
the Reliance on Council I had a lawyer
8:08
that made this deal and he admitted that
8:11
and he was also a totally discredited
8:13
person we weren't allowed to use the
8:15
information from the southern district
8:17
that totally discredited him that wasn't
8:19
allowed to be put in and that was
8:21
terrible
8:23
unbelievable and this is a man who's got
8:25
uh no standing he's been disbarred on
8:30
other matters
8:32
unrelated and he was allowed to talk as
8:35
though he were George Washington but
8:37
he's not George Washington he shouldn't
8:39
have been allowed the southern district
8:41
did a book of approximately 28 Pages uh
8:45
where they I've never seen anything like
8:47
it they excoriated if you wouldn't let
8:49
it be put into evidence so he was able
8:52
to testify as a witness and I think it's
8:55
a disgrace to the system uh I was under
8:58
a gag order I'm the first first
8:59
president in history that was under a g
9:01
go where I couldn't talk about aspects
9:03
of the case that are very important I
9:04
guess I'm still under so probably I
9:06
won't do it now I assume I'm still under
9:09
a gag order but the fact is that uh I'm
9:14
totally innocent I did nothing wrong
9:17
they talked about business records and
9:19
the business records were extremely
9:21
accurately counted I had nothing to do
9:23
with them any that was done by an
9:25
accountant or bookkeeper who uh I think
9:28
gave very credible testimony and was
9:29
corroborated by everybody that was
9:33
asked and with all that's happening in
9:36
our country today with a city that's
9:39
burning to the ground one of our largest
9:41
most important cities burning to the
9:43
ground with with Wars that are
9:45
uncontrollably going on with all of the
9:48
problems of inflation and uh attacks on
9:53
countries and all of the horrible things
9:55
that are going on I got indicted over
9:57
calling a legal expens a legal expense
10:00
was called a legal
10:02
expense uh I just want to say I think
10:04
it's an embarrassment to New York and
10:06
New York has a lot of problems but this
10:08
is a great embarrassment I believe that
10:10
this and other cases that was were
10:12
brought as you know the daj is doj is
10:15
very much involved in this case it's
10:17
because that's the political opponent
10:19
they're talking about the doj is very
10:22
involved you have a gentleman sitting
10:24
right there from the doj who was from
10:26
the doj's office he was also involved
10:28
with the New York State Attorney
10:29
General's case and he went from there to
10:32
here he went around and did what he had
10:34
to do he got them to move on me but in
10:37
the meantime I won the election and a
10:40
massive Landslide and the people of this
10:43
country understand what's going on this
10:44
has been a weaponization of government
10:46
they call it lawfare never happened to
10:49
any extent like this but never happened
10:51
in our country before and I just like to
10:54
exclaim that I was treated very very
10:57
unfairly and I thank you very much
11:00
thank you Mr
11:03
Trump Mr Trump you appear before this
11:05
court
11:06
today to conclude this criminal
11:08
proceeding by the imposition of
11:11
sentence although I have taken the
11:13
unusual step of informing you in advance
11:16
of my
11:17
inclinations before imposing sentence I
11:19
believe it is important for you as well
11:22
as those observing these proceedings to
11:24
understand my reasoning for the sentence
11:27
I am about to impose
11:30
the imposition of sentence is one of the
11:32
most difficult and significant decisions
11:35
that any Criminal Court Judge is called
11:37
upon to
11:40
make our legislature sets the parameters
11:43
for an authorized sentence but it is a
11:46
judge that must decide what constitutes
11:48
a just conclusion to a verdict of
11:52
guilty a court has vested with broad
11:54
discretion in determining what sources
11:56
or evidence it may consider to arrive at
11:59
an appropriate
12:01
sentence in doing so the court must
12:04
consider the facts of the case along
12:07
with any aggravating or mitigating
12:12
circumstances in my time on the bench
12:14
I've been called upon to Grapple with
12:16
this weighty responsibility for
12:18
countless defendants who have been found
12:20
guilty after trial for an assortment of
12:24
offenses ranging from nonviolent classy
12:27
felonies to the most heinous of crimes
12:29
including
12:30
homicides sex trafficking and child
12:33
sexual
12:35
abuse the task is always difficult and
12:38
deserving of careful
12:40
consideration whether the sentence be an
12:42
unconditional discharge or incarceration
12:45
of 25 years to
12:47
life
12:49
however never before has this court been
12:51
presented with such a unique and
12:53
remarkable set of
12:55
circumstances indeed it can be viewed
12:58
fairly
13:00
that this has been a truly extraordinary
13:03
case there was unprecedented media
13:06
attention public interest and heightened
13:09
security involving various
13:11
agencies and yet the trial was a bit of
13:14
a paradox because once the courtroom
13:16
doors were
13:17
closed the trial itself was no more
13:20
special unique or extraordinary than the
13:23
other 32 criminal trials that took place
13:25
in this courthouse at the same exact
13:27
time
13:30
jury selection was
13:32
conducted the same Rules of Evidence
13:34
were followed opening statements were
13:37
made Witnesses called and
13:40
cross-examined evidence presented
13:42
summations delivered the same burden of
13:45
proof was supplied and a jury made up of
13:47
ordinary citizens delivered a
13:50
verdict and it was all conducted
13:52
pursuant to the rules of procedure and
13:55
guided by the
13:57
law of course
13:59
part of what made it feel somewhat
14:01
ordinary was the outstanding work
14:05
preparation and professionalism of the
14:07
clerks Court officers court reporters
14:11
security personnel and the entire staff
14:14
of this building who did their jobs as
14:17
they would with any other criminal
14:21
trial so while one can argue that the
14:23
trial itself was in many respects
14:25
somewhat
14:26
ordinary the same cannot be said about
14:28
the C circumstances surrounding this
14:31
sentencing and that is because of the
14:33
office you once occupied and which you
14:35
will soon occupy
14:38
again to be sure it is the legal
14:41
protections afforded to the Office of
14:44
the President of the United States that
14:46
are
14:48
extraordinary not the occupant of the
14:51
office the legal protections especially
14:54
within the context of a criminal
14:56
prosecution afforded to the office of
14:58
the president have been laid out by our
15:00
Founders the
15:02
Constitution and most recently
15:04
interpreted by the United States Supreme
15:06
Court in the matter of Trump versus the
15:08
United States which was decided on July
15:11
1st
15:20
2024 as with every other defendant in
15:22
your position it is my obligation to
15:25
consider any and all aggravating and
15:27
mitigating factors to inform my
15:30
decision some of those aggravating
15:32
factors have already been articulated in
15:34
my sandal ruling at the start of this
15:37
trial and by my recent written decisions
15:39
on December 16th and January
15:42
3rd thus they not need not be repeated
15:45
at this
15:47
time however the considerable indeed
15:52
extraordinary legal protections afforded
15:54
by the office of the chief chief
15:57
executive is a fact factor that
15:59
overrides all
16:01
others to be
16:03
clear the protections afforded the
16:06
Office of the President are not a
16:08
mitigating
16:10
Factor they do not reduce the
16:12
seriousness seriousness of the crime or
16:16
justify its Commission in any
16:19
way the protections are however a legal
16:23
mandate which pursuant to the rule of
16:25
law this court must respect and and
16:31
followed however despite the
16:34
extraordinary breath of those
16:35
protections one power they do not
16:38
provide is the power to erase a jury
16:41
verdict it is clear from legal
16:43
president which until July 1st was
16:46
scarce that Donald Trump the ordinary
16:50
citizen Donald Trump the criminal
16:53
defendant would not be entitled to such
16:55
considerable protections
16:58
I'm referring to protections that extend
17:00
well beyond those afforded the average
17:02
defendant who winds their way through
17:04
the criminal justice system each
17:07
day
17:08
no ordinary citizens do not receive
17:11
those legal
17:13
protections it is the Office of the
17:15
President that bestows those
17:17
far-reaching protections to the office
17:20
holder and it was the citizenry of this
17:23
nation that recently decided that you
17:25
should once again receive the benefits
17:27
of those protections
17:29
which include among other things the
17:32
supremacy clause and presidential
17:36
immunity it is through that
17:39
lens and that reality that this court
17:43
must determine a lawful
17:47
sentence after careful analysis in
17:50
obedience to governing mandates and
17:53
pursuant to the rule of
17:54
law this court has determined that the
17:57
only lawful sentence that permits entry
18:01
of a judgment of
18:02
conviction without encroaching upon the
18:05
highest surus in the land is an
18:07
unconditional
18:09
discharge which the New York State
18:11
Legislature has determined is a lawful
18:14
and permissible sentence for the crime
18:17
of falsifying business records in the
18:18
first
18:20
degree therefore at this time I impose
18:24
that sentence to cover all 34
18:27
counts sir I wish you God's speed as you
18:30
assume your second terminal office thank
18:34
you bringing you needs in a more Digital
18:38
Way
